Introduction

Welcome to Epic Plane Evolution. These Terms of Service ("Terms") govern your use of the Epic Plane Evolution mobile application ("App") operated by us.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.

User Accounts

When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the App.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.

Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Epic Plane Evolution and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Epic Plane Evolution.

User Content

Our App may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post on or through the App, including its legality, reliability, and appropriateness.

By posting User Content on or through the App, you represent and warrant that: (i) the User Content is yours and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your User Content on or through the App does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity.

In-App Purchases

The App may include the option to purchase virtual, in-game items. You acknowledge that:

• All purchases of virtual currency and virtual items are final and non-refundable, except as required by applicable law.
• You do not own the virtual items; instead, you receive a limited, personal, revocable, non-transferable license to use such virtual items solely for your personal entertainment purposes.
• We reserve the right to control, regulate, change, or remove any virtual items without any liability to you.
• The price and availability of virtual items are subject to change without notice.

Prohibited Activities

You may not access or use the App for any purpose other than that for which we make the App available. The App may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the App, you agree not to:

• Systematically retrieve data or other content from the App to create or compile, directly or indirectly, a collection, compilation, database, or directory.
• Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
• Circumvent, disable, or otherwise interfere with security-related features of the App.
• Use any information obtained from the App in order to harass, abuse, or harm another person.
• Use the App as part of any effort to compete with us or otherwise use the App and/or the Content for any revenue-generating endeavor or commercial enterprise.
• Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the App.
• Attempt to bypass any measures of the App designed to prevent or restrict access to the App, or any portion of the App.
• Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the App to you.
• Delete the copyright or other proprietary rights notice from any Content.
• Use the App in a manner inconsistent with any applicable laws or regulations.

Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the App.

Limitation of Liability

In no event shall Epic Plane Evolution, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any conduct or content of any third party on the App; (iii) any content obtained from the App; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.
